These Terms and Conditions govern your access to and use of primeautohaus.com, including all services, content, forms, and engagements offered by Prime Auto Haus, operated by Popsbuilder Group LLC, an Illinois limited liability company ("Company," "we," "us," or "our").
By accessing this website, submitting a hunt request, submitting a spotted tip, engaging us for buy-side brokerage services, or otherwise engaging with the Prime Auto Haus brand, you agree to be bound by these Terms. If you do not agree to these Terms, do not use this site or engage our services.
These Terms constitute a legally binding agreement between you and Popsbuilder Group LLC. Please read them carefully before proceeding.
Prime Auto Haus offers the following.
We do not sell vehicles, take title to vehicles, hold client funds, or act as a licensed dealer. We do not provide financing, escrow, inspection, transport, or title services directly, though we may refer clients to third-party providers for these services.
We reserve the right to modify, suspend, or discontinue any service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.
A brokerage engagement begins upon mutual agreement between you and Prime Auto Haus, documented in a written engagement letter or equivalent communication that specifies the target vehicle, scope of work, and applicable finder's fee.
By engaging us for buy-side brokerage services, you acknowledge the following.
Our opinions on a vehicle, including recommendations to buy, pass, or wait, reflect our professional judgment as enthusiasts and are not a warranty, guarantee, or appraisal. We do not guarantee the authenticity, condition, history, mileage, title status, or fitness for any purpose of any vehicle we source or introduce to you.
Our compensation is a finder's fee, negotiated and agreed in writing for each engagement. Fees are structured as a flat fee, a percentage of the final purchase price, or a combination of the two, as documented in the applicable engagement letter.
The finder's fee becomes due and payable upon title transfer or, in financed transactions, upon the completion of financing, whichever applies. You will wire the finder's fee to Popsbuilder Group LLC directly, separate from and in addition to the purchase funds paid to the seller.
No finder's fee is owed if no vehicle is acquired through our engagement. Once a transaction closes and the fee is paid, the finder's fee is non-refundable.
We do not charge deposits, retainers, or recurring fees. You owe us a fee only when you drive the right vehicle home.
When you submit a tip, photo, or other content to Prime Auto Haus through the Spotted form or any other channel, you grant Popsbuilder Group LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content on our website, social channels, and marketing materials, with or without attribution.
By submitting, you represent that you have the right to submit the content, that the content does not infringe any third party's rights, and that you are submitting voluntarily and without expectation of compensation.
All content on primeautohaus.com, including written content, brand assets, the "Prime Auto Haus" name, the "Otto" persona, the monogram, and original photography and video, is the exclusive intellectual property of Popsbuilder Group LLC and is protected by applicable copyright, trademark, and other intellectual property laws.
You may share links to publicly available content and quote brief excerpts for non-commercial commentary, provided you clearly attribute the source.
All content and services offered through primeautohaus.com are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
Our opinions on vehicles, markets, values, and deals reflect our professional judgment as enthusiasts and are not appraisals, inspections, or guarantees. Individual results vary. Testimonials, case studies, and content featured on our social channels represent specific experiences and are not guarantees of similar outcomes.
To the fullest extent permitted by law, Popsbuilder Group LLC, its principals, affiliates, contractors, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or our services, including but not limited to lost profits, lost opportunities, diminished vehicle value, defects discovered after purchase, title disputes, or data loss.
In no event shall our total aggregate liability to you for any claim, whether in contract, tort, or otherwise, exceed the finder's fee actually paid by you to Popsbuilder Group LLC in connection with the engagement giving rise to the claim, or one hundred dollars ($100), whichever is greater.
We reserve the right to suspend or terminate your access to this site or our services at our discretion, including but not limited to the following cases.
Either party may terminate an active brokerage engagement at any time by written notice. Termination does not affect a finder's fee that has already become due under Section 03.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
We reserve the right to update these Terms at any time. Continued use of this site or our services after any changes constitutes your acceptance of the revised Terms. Material changes will be communicated by updating the effective date at the top of this page.
